The attribute of the right of assembly to position itself functionally in scenarios of coincidence with another series of liberties and protectable rights, for some with a profile of instrumentality and for others of affectation, makes it a right of particular complexity. From the multiplicity of viewpoints from which the analysis of the right of assembly can be approached, here is proposed a not static but dynamic perspective of the doctrine emanated from the ECHR on the protective and restrictive margins that the recognition of the right of assembly is dispensed in article 11 of the Convention, contemplating its possible projection in the area of regulation that this right receives in the Spanish legal system, and in a particular way when it is exercised in the field of labor relations
La propiedad del derecho de reunión de situarse funcionalmente en escenarios de coincidencia con otra serie de libertades y derechos protegibles, para unos con un perfil de instrumentalidad y para otros de afectación, hace de él un derecho de particular complejidad. De la multiplicidad de observatorios desde los que cabe abordar el análisis del derecho de reunión, se propone aquí una perspectiva ya no estática sino dinámica de la doctrina emanada del TEDH sobre los márgenes protectores y limitadores que dispensa el reconocimiento del derecho de reunión en el art.11 del CEDH, contemplando su posible proyección en el espacio de ordenación que recibe este derecho en el sistema jurídico español, y de manera particular cuando se ejercita en el ámbito de las relaciones laborales
