Las normas voluntarias SA8.000 e ISO 26.000 sobre responsabilidad social y su importancia ante la debilidad del derecho

Las normas SA8000 e ISO 26.000 se ocupan de la protección de las condiciones laborales de los empleados y del respeto a los derechos básicos del hombre. La norma ISO 26.000 además se ocupa de los ámbitos sociales, económicos y ambientales (desarrollo sustentable). A través de tres fases metodológicas (exploratoria, descriptiva y analítica) se pudo cumplir con el objetivo principal del presente trabajo, que fue realizar un análisis comparativo de los aspectos y de la evolución de ambas normas voluntarias (ISO 26.000 y SA8.000). A continuación, una vez obtenida esta información se establecieron fortalezas y debilidades de ambas normativas. Sin embargo, debido a que el Derecho con su principio de "obligatoriedad" en sus normas se encuentra relativamente ausente en las algunas cuestiones vinculadas con la ética, resulta clave darle un lugar primordial a las normas voluntarias que lo complementan. El papel del Derecho internacional resulta clave en el análisis de esta cuestión, debido a que muchas veces no es tenido en cuenta por los juristas o jueces que propugnan fuertemente por diversos derechos básicos del hombre que se vinculan directamente con la responsabilidad social

ISO 26.000 also verses on social, economic and environmental areas (Sustainable Development). Three methodological stages (exploratory, descriptive and analytic) were used to achieve the main aim of this paper, which was to compare the main features and the evolution of both voluntary laws (ISO 26.000 and SA8000). Then, with this information, we could show their strengths and weaknesses. Notwithstanding, due to the fact that mandatory legal norms are absent regarding the fulfillment of some ethical duties, these voluntary norms should also be taken into account in order to complement Law. International Law is very important in the analysis of these issues, due to the fact that it is not generally applied by jurists and/or judges, and this discipline enforces several mens basic rights which are part of Social Responsibilitys objectives
