In the section of the Digest concerning -de instructo vel instrumento legato‖ there is a text by Ulpianus that seems on first glance to offer an interesting ius controversum. Determining the contents of instrumenta fundi has depended on a jurisprudential criterion that has been practically unanimous since Sabinus, according to which both agricultural machinery and slaves and animals used for labor in the fields form a part of the -farm implement‖, and therefore of the instrumentum legatum. However, Alfenus Varus distances himself from this criterion in that he excludes all living beings from the catalog of instrumenta fundi. I propose a revised reading of Ulpianus' text, particularly that part which concerns Varus' -supposedly‖ singular doctrine
En el título del Digesto relativo al -de instructo vel instrumento legato‖ se reco-ge un texto de Ulpiano que parece a primera vista consagrar un interesante ius controversum. La determinación del contenido de los instrumenta fundi sigue un criterio jurisprudencial prácticamente unánime desde Sabino, según el cual tanto maquinaria agrícola como esclavos y animales destinados a las tareas del campo forman parte del -apero‖, y, por tanto, del objeto del instrumento legato. Sin embargo, Alfeno Varo se distancia de tal criterio, ya que excluye a los seres animados de la catalogación de instrumenta fundi. Mi propuesta pasa por revi-sar la lectura del texto de Ulpiano, y, en particular, aquella parte donde se nos da noticia de la supuesta‖ doctrina singular de Varo
