The paper deals again with the problem of identifying the extinctive and preclusive effects of the litis contestatio with regard to the specific category of the roman actiones populares. To this end, a new exegesis of the Iulianus' fragment that we can read in D. 47.12.6 appears to show that the preclusive effect, with reference to the is cuius interest, is determined at the time of the litis aestimatio
En el este ensayo se toman en consideración nuevamente las cuestiones relativas a la operatividad del efecto preclusivo y extintivo de la litis contestatio, en esa especial categoría de acciones, que son las actiones populares romanas. En particular, el fragmento de Juliano D. 47.12.6 se somete a una nueva exégesis, en el cual el límite de preclusión previsto por el is cuius interest en el ejercicio de la actio de sepulchro violato parece estar fijado en el momento de la litis aestimatio
