The article approaches the way how the exercise of the States sovereignty can be affected by the signature of international agreements on investment. Distinguishing the application of the national law respect to the international law, the author reviews the basic concepts to understand the relation between sovereignty and international agreements. For it, the diverse forms in commercial agreements are analyzed, stopping in international treaties subscribed by Chile and in the different effects that each one of them generates on its regulatory powers
El artículo aborda la forma como el ejercicio de la soberanía por parte de los Estados se ve afectada por la firma de acuerdos internacionales de inversión. Distinguiendo la forma de aplicación del derecho interno respecto del derecho internacional, el autor revisa los conceptos básicos para comprender la relación entre soberanía y acuerdos internacionales. Para ello, se revisan las diversas formas de acuerdos comerciales, deteniéndose en los tratados internacionales suscritos por Chile y en los diferentes efectos que cada uno de ellos genera sobre sus poderes regulatorios
