Característica relacional y mutabilidad de los contratos estatales: la concesión como herramienta de planeación

This paper examines the new Brazilian model of "public services" provided through public relational contracts. It also analyzes the issue of lack of correspondence between a legal regime of the 20th century and the demands of the 21st century. The research hypothesis suggests the need to recognize the mutability of "public service" concessions. By means of a deductive method and a bibliographic research technique, the research work seeks to demonstrate how the acknowledgement of the relational and procedural nature of the concession can be a planning tool for the realization of fundamental rights, the stabilization of legal relations and a greater democratic legitimacy

Este trabajo examina el nuevo modelo brasilero de servicios públicos prestados mediante contratos estatales relacionales, al tiempo que analiza el problema de la falta de correspondencia de un régimen legal del siglo xx con las demandas del siglo xxi. La hipótesis de investigación sugiere la necesidad de reconocer la mutabilidad de las concesiones de servicio público, a través del método deductivo y la técnica de investigación bibliográfica. El trabajo que se presenta busca demostrar cómo la concesión, desde que se reconozca su naturaleza relacional y procesal, puede ser un instrumento de planeación para la realización de los derechos fundamentales, la estabilización de las relaciones jurídicas y para una mayor legitimidad democrática
