At the end of the next 9th of March 2019, one year after the entry inti force of LCSP/2017, the explicit references regarding urban planning will be reviewed by the author, analysing the impact of public procurement regulations on it. The review will start with the study of the implementation in 1994 of the Urban Development Agent as a disruptive system, followed by the legal analysis of the urban planning agreement subscribed between the Administration and the figure of the Urban Development Agent. Additionally, it will also address how the case-low of the Spanish Supreme Court and the Court of Justice of the European Union have been gradually gathering the application of Public Procurement Regulation to the selection of the Urban Development Agent and the execution of new urban development processes, to conclude with a brief selection of case-law and final assumptions
Al cumplirse el próximo 9 de marzo de 2019 un año de la entrada en vigor de la LCSP/2017, se analiza por el autor las referencias expresas que dicho texto legal hace al urbanismo, analizando la incidencia que la normativa de la contratación pública tiene sobre el mismo, comenzando con el estudio de la implantación en el año 1994 de la figura del agente urbanizador como sistema disruptivo, analizando la naturaleza jurídica del convenio de gestión urbanística que suscribe la Administración actuante con este agente urbanizador, y como la jurisprudencia emanada del Tribunal Supremo y del TJUE ha ido recogiendo paulatinamente la aplicación de la normativa de contratación pública a la selección del agente urbanizador y a la ejecución de las nuevas actuaciones urbanizadoras, recogiendo una breve selección de jurisprudencia sobre esta materia, y unas conclusiones finales
