Del patrimonio público una aproximación al concepto y a su contenido

The public patrimony is a concept of public law, of wide range, that surpasses in its content the concept of patrimony of the State. The definition as a unit or as a plurality of each and its ownership contribute to facilitate their particular content and the exercise of the rights and actions that public authorities must practice in order to preserve their integrity. The concept concerns to the public management science and is fundamental in the field of the administrative law. It constitutes object of management and object of preservation to avoid attacks against itself, to remedy created situations or to judicially take part for its restoration or resetting. The public patrimony is in the interest of the internal and international order, the patrimony of the State, at first, involves the domestic law in the private and administrative order, following the principle that affirms that the state is characterized by its subjection to the law, as every public or private subject is.

El Patrimonio Público es un concepto de derecho público, de amplio espectro, que supera en su contenido al de Patrimonio Estatal. La definición en cuanto a la unidad o la pluralidad de uno y otro, y su titularidad contribuyen a facilitar su contenido particular y el ejercicio de las facultades y de las acciones que las autoridades públicas deben practicar para preservar su integridad.El concepto atañe a la ciencia de la administración pública y es fundamental en el campo del derecho público administrativo. De una parte constituye objeto de gestión y por la otra objeto de preservación para evitar atentados contra el mismo, remediar situaciones creadas, o intervenir judicialmente para su restauración o recomposición.El Patrimonio Público interesa al orden interno y al orden internacional, el Patrimonio Estatal, en principio toca con el derecho interno tanto en el orden privado como en el administrativo, en atención al principio según el cual el estado de derecho se caracteriza por su sujeción al ordenamiento jurídico, como corresponde a todo sujeto de naturaleza pública o privada
