"... y todos ellos roban a sus conciudadanos": acerca del delito de contrabando en el siglo XIX colombiano

This article examines how contraband was perceived and punished in Colombia between 1821 and 1886. To do so, it first establishes how authorities viewed contraband and then reviews how violators were sanctioned, comparing these punishments with the evolution of the legal system over the same period. Finally, the article addresses the actually-applied punishments in order to evaluate whether the letter of the law was followed. By discerning how authorities viewed this crime, the coherence between these views and its penalization, the relationship between this sanction and other existing punishments and their application, the article attempts to determine how contraband was perceived

Este artículo examina cómo fue considerado y sancionado el contrabando en Colombia entre 1821 y 1886. Para ello, establece primero la manera como fue calificado por las autoridades, para luego revisar las penas a las que fueron sometidos sus actores y contrastarlas con la evolución que conoció el derecho en el mismo periodo. Finalmente se abordan los castigos efectivamente aplicados en aras de evaluar si lo planteado en la legislación se hizo realidad. Este recorrido busca establecer la percepción de las autoridades sobre este delito, la coherencia de ésta con su penalización, la relación de este tratamiento legal con el resto de castigos existentes y la aplicación de estas sanciones, para así determinar cómo era visto el contrabando
