Due to the extraordinary value that the voluntary will of the relationship of a couple, we propose to examine the main agreements that organize personal and financial effects, from current coexistence, and in advance, to those provisional of the effects of a future cohabitational crisis. The negotiation of these legal instruments, that vacillate between the protection of the freedom of its parties and the principles that constitute family public order, are analyzed from the perspective of the Spanish legal system and the regulations that are provided in the civil law of Catalonia, in which different types of agreements are contemplated in view of the timing of their effects
Dado el extraordinario valor que reviste la voluntad en las relaciones de pareja, se propone el examen de los principales acuerdos encaminados a organizar los efectos personales y patrimoniales, vigente la convivencia y de manera anticipada, aquellos provisorios de los efectos de una futura crisis convivencial. Estos instrumentos jurídicos negociales, que basculan entre la protección de la libertad de sus otorgantes y la de los principios que constituyen el orden público familiar, se analizan desde la perspectiva del ordenamiento jurídico español, y desde la regulación que se dispone en el derecho civil de Cataluña, en el cual se contemplan distintas modalidades de acuerdos en atención a la proyección temporal de sus efectos
