Against the autonomy of the...
The definitive establishment of public-private governance has forced to abandon the theories of political autonomy that were valid until a few decades ago. In return, there has been a boom in the autonomy of the right conceived as a recovery of the natural law inherent to Human Rights. This article rescues from oblivion the two main criticisms made in the second half of the twentieth century to Human Rights: that of the conservative jurist Ernst Forsthoff and that of the Marxist philosopher Antonio Negri. Although these thinkers are completely antagonistic from the point of view of their political projects, both agree that, in the current technical societies where collaborative work prevails, the liberal conception of right is no longer able to function as a guarantor of the freedoms and empowerment of citizens: it has lost all capacity for control and organization of material production relationships
El definitivo asentamiento de las gobernanzas público-privadas ha obligado a abandonar las teorías de la autonomía de lo político vigentes hasta hace pocas décadas. Como contrapartida, se ha producido un auge de la autonomía de lo jurídico concebida desde teorías iusnaturalistas supuestamente inherentes a los Derechos Humanos. Este artículo analiza las dos críticas principales realizadas a los Derechos Humanos en la segunda mitad del siglo XX desde planteamientos políticos claramente divergentes: la del jurista conservador Ernst Forsthoff y la del filósofo marxista Antonio Negri. La conclusión obtenida es que ambas posturas mantienen que en las actuales sociedades técnicas donde prima el trabajo colaborativo, la autonomía de lo jurídico propia de la concepción liberal del derecho ya no es capaz de funcionar como garante de las libertades y el empoderamiento de los ciudadanos, pues ha perdido toda capacidad de control, organización y fiscalización de las relaciones materiales de producción
