The Criminal Code of the Russian Federation in the Article 156 establishes criminal responsibility for dereliction of underage children education. The author of the article discusses issues related to the difficulties that arise in law enforcement practice in case of criminal legal characterization of the crime. First of all, these difficulties are related to the interpretation of the concept of "child abuse". The identification of this feature is the most difficult, as it relates to the evaluation categories. Based on specific criminal cases considered by the courts according to the Article 165 of the Criminal Code and according to the opinions of scientists, the author attempted to generalize the results to develop a uniform approach to the determination of the legal nature of "the dereliction of duties in the process of underage children education connected with children abuse". The article explains the necessity of the adoption of a regulation by Supreme Court Plenum relating to the litigations of child abuse cases according to the differences in the application of the Criminal Code norms on the responsibility for dereliction of duties in the process of underage children education in order to facilitate its ordering
