Campo Verde, Jujuy - 2021: ...
The article will seek to reflect on the state approach to social conflicts in the province of Jujuy, based on the study of a case that will allow us to analyze some of the local ways in which the exercise of state power has manifested itself, in times of COVID-19 Pandemic. In March 2021, in the Campo Verde neighborhood of San Salvador de Jujuy, a series of acts of state violence took place against neighborhood protests in defense of a public space. The "Campo Verde" case will be studied by investigating how the State and the different state bureaucratic agencies intervened in the conflict, at the same time it will be analyzed what was the neighborhood response to state actions. Special consideration will be given to inter-American standards on the exercise of the right to social protest, as well as to the State's human rights obligations that should guide institutional responses to such conflicts. From the study carried out, a process of infra-criminalization of the state agents who starred in the repressive acts and of over-criminalization of the neighbors who participated in the protest on whom criminal and contraventional cases were initiated was evidenced. In this way, the repression and criminalization of protest were the state responses to a conflict that should have been addressed in a democratic, participatory and deliberative way
El artículo buscará reflexionar sobre el abordaje estatal de los conflictos sociales en la provincia de Jujuy, a partir del estudio de un caso que nos permitirá analizar algunas de las formas locales en que se ha manifestado el ejercicio del poder estatal, en tiempos de Pandemia COVID-19. En marzo de 2021, en el barrio Campo Verde de San Salvador de Jujuy, tuvieron lugar una serie de hechos de violencia estatal en contra de protestas vecinales en defensa de un espacio público. El caso "Campo Verde" será estudiado indagando de qué manera el Estado y las diferentes agencias burocráticas estatales intervinieron en el conflicto, al mismo tiempo se analizará cuál fue la respuesta vecinal ante las acciones estatales. Se tendrá especialmente en cuenta los estándares interamericanos sobre el ejercicio del derecho a la protesta social, como así también las obligaciones estatales en materia de derechos humanos que deben guiar las respuestas institucionales frente a este tipo de conflictos. A partir del estudio realizado se evidenció un proceso de infra-criminalización de los agentes estatales que protagonizaron los hechos represivos y de sobre-criminalización de los vecinos que participaron en la protesta sobre quienes se iniciaron causas penales y contravencionales. De esta forma, la represión y la criminalización de la protesta fueron las respuestas estatales ante un conflicto que debería haberse abordado de forma democrática, participativa y deliberativa
