Bei der Entstehung der Bioethik bilden die Menschenrechte die Grundlage. Sie stehen im Zusammenhang mit den Fragen die unsere Körperlichkeit betreffren, mit der wir geboren werden, und die vom Gesetz geschützt werden muss, und daher sollten sie am Beginn des obligatorischen Schritts zur Biopolitik stehen. Der Körper wurde zum bevorzugten Terrain des Machtbereichs der Medizin und die Auseinandersetzung zwischen Biopolitik, Medizinisierung und Biomacht entstand. Wenngleich das Recht immer mehr als ein stufenweise sich ausdehnendes Netz erscheint, das sowohl den etablierten juristischen als auch den externen und informellen Begriffen Zutritt gewährt und sich zwischen dem Positiven Recht und der sozialen Praxis (diesen juristisch nicht fassbaren Raum des dehnbaren Rechts) auswirkt, stellt sich die Frage: Welchen sozialen Druck üben die Personen und die öffentliche Meinung auf die Rechtssysteme aus, die sie tagtäglich herausfordern?
The human rights which are on the foundations of the birth of bioethics are related to the topics concerning the human body we are born with, which has to be ruled by law and which must subsequently make the origin of the necessary look onto biopolitics. Human body made privileged land for medical power and an interaction in between biopolitics, medicalisation and biopower arose. However, the law is becoming more and more a stepped network which welcomes other factors than the established legal meanings, namely those external and informal factors which are halfway in between social praxis (the space outside the margins of the law we could possibly define as flexible law). What kind of pressure and to what extend do people and public opinion apply on the daily password laws they have to overcome?
Los derechos humanos que están en la base del nacimiento de la bioética están relacionados con las temáticas vinculadas al cuerpo con el que se nace en el mundo, que tiene que ser tutelado por la ley y que, por tanto, debe constituir el origen del paso obligado a la biopolítica. El cuerpo se convirtió en territorio privilegiado del poder médico y comenzó a tomar forma la interacción entre biopolítica, medicalización y biopoder. Si bien el derecho aparece cada vez más como una red escalonada que permite la entrada, junto a los significados jurídicos consolidados, de otros externos e informales entre el derecho positivo y la praxis social (aquel espacio no jurídico definible como derecho flexible), qué tipo de presión ejercen y qué espacio de penetración consiguen las personas, la opinión pública, sobre el derecho de los códigos que desafían a diario?
