The Infraction Report is the document issued by Labor Inspectors when they conclude their inspection actions and determine violations due to non-compliance with socio-labor regulations, occupational safety and health, or inspection duties. It includes the verified facts that constitute potential violations, the specific acts that fall under these violations, the affected regulations, their classification and typification as violations, as well as the proposed sanction, along with the respective criteria for quantification and grading. It specifies the responsibility of the inspected party, with the appropriate factual and legal justification. Therefore, the Infraction Report constitutes the central axis upon which the administrative sanctioning procedure is based. As such, it must adhere to the guidelines established by the Labor Inspection, fulfilling each of the requirements set forth in the General Labor Inspection Law, its regulations, and other provisions governing the inspection procedure. However, currently, many Infraction Reports are not issued in compliance with the legal framework. This leads to the violations listed in the report not being upheld, and in some cases, the procedure being archived, thereby impacting the service provided by the Labor Inspection
El Acta de Infracción, es el documento emitido por los Inspectores de Trabajo cuando culminadas sus actuaciones inspectivas, determinan la existencia de infracciones por incumplimiento a la normativa sociolaboral, seguridad y salud en el trabajo o a la labor inspectiva, la cual comprende los hechos acreditados pasibles de infracción, los hechos que se subsumen a dichas infracciones, las normas afectadas, su calificación y tipificación como infracciones, así como la sanción que es propuesta, además de los respectivos criterios de cuantificación y graduación, precisándose la responsabilidad del sujeto inspeccionado, con la debida fundamentación de hecho y de derecho. En función a ello, el Acta de Infracción constituye el eje central sobre la cual se sustentará el procedimiento administrativo sancionador, por lo cual, dicha Acta debe sujetarse a los lineamientos establecidos por la Inspección del Trabajo, cumpliendo con cada uno de los requisitos contemplados en la Ley General de Inspección del Trabajo, su Reglamento y otras disposiciones que rigen el procedimiento inspectivo. Sin embargo, actualmente, muchas de las Actas de infracción no son emitidas cumpliendo el ordenamiento legal, lo que deriva en que la o las infracciones contenidas en el Acta, no sean acogidas y, en algunos casos, se disponga el archivo del procedimiento, afectándose el servicio prestado por la Inspección del trabajo
