The main purpose of this article is to expose the phenomenon of hitmen through the participation of adolescents, who in recent years have been used as the armed wing of organized crime in México to perpetrate high-impact crimes such as, for example: kidnappings, homicides, femicides and even crimes against health; the main problem focuses on establishing, on the one hand, the low custodial sentences that are given to adolescents depending on the age group to which they belong in accordance with the National Law of the Comprehensive Justice System for Adolescents and, on the other hand, yes, the simple fact of being adolescents does not have the capacity to understand and understand the illegality of their actions in accordance with the theory of the crime in order to obtain a sentence proportional to the rights of the victims
El presente artículo tiene como principal propósito exponer el fenómeno del sicariato a través de la participación de adolescentes, mismos que en los últimos años han sido utilizados como brazo armado de la delincuencia organizada en México para perpetrar delitos de alto impacto como, por ejemplo: secuestros, homicidios, feminicidios y hasta delitos contra la salud; el problema principal se centra en establecer, por un lado, las penas privativas de la libertad tan bajas que se les dan a los adolescentes dependiendo del grupo etario al que pertenezcan conforme a la Ley Nacional del Sistema Integral de Justicia para adolescentes y, por otro, si por el simple hecho de ser adolescentes no tienen la capacidad de entender y comprender la ilicitud de sus actos conforme a la teoría del delito para poder obtener una pena proporcional frente a los derechos de las víctimas
