The general objective of the research was to legally analyze incestuous rape as an autonomous and independent crime in the Ecuadorian Organic Integral Penal Code. The method used in the research was based on the qualitative approach, handling the collection and analysis of a documentary-bibliographic typology. The research technique applied was the interview; the tool or instrument that supported it was the interview guide; which was applied to lawyers in free exercise of the profession with extensive theoretical and practical knowledge in the field of criminal law. Generating an analytical-reflexive process, contributing to the generation of the extension of the state of the art. It is concluded that overcriminalization in criminal law has several manifestations, among which it is worth mentioning the creation of new criminal types or the increase of the sanctioning framework in the existing ones without a valid justification of legislative technique
El objetivo general de la investigación fue analizar jurídicamente la violación incestuosa como un delito autónomo e independiente en el Código Orgánico Integral Penal ecuatoriano. El método empleado en la investigación, se basó en el enfoque cualitativo, manejando la recolección y análisis de una tipología documental-bibliográfica. La técnica de investigación aplicada fue la entrevista; la herramienta o instrumento que apoyó fue la guía de entrevista; la cual se aplicó a los abogados en libre ejercicio de la profesión con amplios conocimientos teóricos y prácticos en el ámbito del Derecho penal. Generándose un proceso analítico-reflexivo, contribuyendo a la generación de la extensión del estado del arte. Se concluye que, la sobrecriminalización en el Derecho penal tiene varias manifestaciones, entre las que cabe señalar la creación de nuevos tipos penales o el aumento del marco sancionador en los existentes si una justificación válida de técnica legislativa
