The Theory of Law provides analytical tools and principles through which both legal norms and their application in court can be analyzed. In this essay, a sentence analysis is made from the point of view of the different methods of legal interpretation and their scope, to resolve a particularly complex problem such as the unconstitutionality of a constitutional norm, determined in light of an advisory opinion of the IACHR of which Ecuador was not a consulting State, and of an extensive interpretation of constitutional principles and rights that entailed a mutation of the current text, thereby exceeding the jurisdiction of the Constitutional Court of Ecuador (CCE)
La Teoría del Derecho aporta herramientas analíticas y principios mediante los cuales se pueden analizar tanto las normas jurídicas como su aplicación en sede judicial. En este ensayo se hace un análisis de sentencia desde el punto de vista de los diferentes métodos de interpretación jurídica y su alcance, para resolver un problema particularmente complejo como es la inconstitucionalidad de una norma constitucional, determinada a la luz de una opinión consultiva de la CIDH de la que Ecuador no fue Estado consultante, y de una interpretación extensiva de principios y derechos constitucionales que supuso una mutación del texto vigente, excediendo con ello la competencia de la Corte Constitucional del Ecuador (CCE)
