CONTEXT: It is part of the institutional context of the law and literature movement. Provides a reading on the loan agreement summarized in topic 4. OBJECTIVE: Explain the use of law and literature in contract law, especially in relation to loan, fees and loan sharking. METHOD: Based on the methodology of law in literature, it examines the notions of loan, loan sharking and fees in the short story "The Loan", by Machado de Assis. RELEVANCE/ORIGINALITY: The relevance of the debate is to remove law from dogmatic confinement through an approach to law in literature. RESULTS: It shows the problem of legal exclusivism and suggests the possibility of apprehending the law through the literature. THEORETICAL/ METHODOLOGICAL CONTRIBUTIONS: What is intended with the article is a greater opening of legal dogmatics to interdisciplinary collaboration. KEYWORDS: Loan agreement. Law and Literature. CONTEXTO: Insere-se no contexto institucional do movimento direito e literatura. Oferece uma leitura sobre o contrato de empréstimo sintetizada no tópico 4. OBJETIVO: Explicitar o emprego do direito e literatura no direito contratual, especialmente, em relação ao mútuo, juros e agiotagem. MÉTODO: Com base na metodologia do direito na literatura, examina as noções de mútuo, agiotagem e juros no conto "O Empréstimo", de Machado de Assis. RELEVÂNCIA/ORIGINALIDADE: A relevância do debate é retirar o direito do enclausuramento dogmático por meio de uma abordagem do direito na literatura. RESULTADO: Mostra o problema do exclusivismo jurídico e sugere a possibilidade de apreender o direito por meio da literatura. PRINCIPAIS CONTRIBUIÇÕES TEÓRICAS/METODOLÓGICAS: O que se pretende com o artigo é uma maior abertura da dogmática jurídica à colaboração interdisciplinar. PALAVRAS-CHAVE: Mútuo. Direito e Literatura.
