O objetivo deste trabalho foi analisar a figura jurídica do direito de participação ou droit de suite, com o fim de identificar sua aplicabilidade na Colômbia, que efeitos teria implementar esta figura jurídica em nossa legislação e como poderia, eventualmente, modificar a comercialização das obras de arte e a situação dos artistas plásticos na Colômbia. Concluiuse, entre outras coisas, que sua aplicação poderia restabelecer a igualdade entre os artistas plásticos e os demais autores, reivindicar o valor da arte, promover a produção artística e favorecer a capacidade econômica dos artistas
The purpose of this article was to analyze the legal concept of resale right or droit de suite, in order to identify its applicability in Colombia, the effects of implementing this right in our legislation and how it could possibly change the marketing of art and the artists' situation in Colombia. It was concluded among other things, that its application could restore equality between visual artists and other authors, promote artistic creation, favor the value of art works and support the artist's economic capacity
El objetivo de este trabajo fue analizar la figura jurídica del derecho de participación o droit de suite, con el fin de identificar su aplicabilidad en Colombia, qué efectos tendría implementar esta figura jurídica en nuestra legislación y cómo podría, eventualmente, modificar la comercialización de las obras de arte y la situación de los artistas plásticos en Colombia. Se concluyó, entre otras cosas, que su aplicación podría restablecer la igualdad entre los artistas plásticos y los demás autores, reivindicar el valor del arte, promover la producción artística y favorecer la capacidad económica de los artistas
