Transcurridos tres décadas desde que la primera norma española en materia de protección de datos se promulgó, la LORTAD, y cuando la realidad tecnológico-digital ha superado con creces cualquier previsión futurista es el momento de preguntarse sobre la vigencia el derecho a la protección de datos y la arquitectura legal que le da soporte en el ámbito de las relaciones laborales, tomando como referencia el caso paradigmático de las decisiones algorítmicas que afectan al trabajador
